a) The following representation and conditions apply to the aforementioned puppy/dog: Seller guarantees that puppy/dog is free of life-threatening genetic diseases or disabilities (i.e., Legg Calve Perthes, PRA/PRCD1) for 3 years after delivery to Buyer. There is no guarantee given nor implied regarding hip dysplasia and/or luxating patella’s as both of these are caused by a multitude of factors, including diet and exercise (or lack thereof). b) If puppy/dog is being purchased for a show/breeding prospect seller guarantee’s puppy/dog to pass all breed appropriate genetic testing. If puppy/dog does not pass breed appropriate genetic testing Buyer must notify breeder/seller with the failed genetic testing results to breeder/seller within 72 hours by email. Once breeder/seller is notified the buyer must spay/neuter puppy/dog, provide proof to breeder/seller and either keep puppy/dog as a companion, return puppy/dog to the breeder/seller or place puppy/dog in an appropriate companion home that is approved by breeder/seller. Breeder/seller will replace puppy/dog with another puppy/dog that is of the same value and quality when one becomes available. No monies will be refunded including but not limited to deposit, purchase price, maintenance costs, shipping/delivery fees, veterinary expenses, etc.
c) The buyer has 72 business hours to have the puppy/dog examined by a licensed Veterinarian. If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health, then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the seller for a replacement. This does not include any type of internal or external parasite(s), coccidia, giardia. If the Buyer elects to return the puppy/dog, Buyer shall within 7 days after the date of the signing of this contract, send to the seller by certified mail, a written Veterinarians certificate stating that the puppy/dog was ill when examined, along with a second written certificate by a different Veterinarian in a different office, stating the same. Upon the receipt by Seller of said certificates, Buyer shall be obligated to return the puppy/dog and Seller will provide another puppy/dog when one is available. Buyer is responsible for all expenses related to shipment, nonstop flights, etc. Buyer shall be solely responsible for all costs and related expenses of returning puppy/dog to Seller. Should Buyer decide to keep puppy/dog Buyer forfeits all claims and shall be solely responsible for any and all future Veterinarian bills for puppy/dog.
d) Ownership/Possession of the puppy/dog will be transferred to Buyer for the sale price of $2500.00 as companion/performance prospect or $______ as a show/breeding prospect. It is to be paid as follows: $500.00 as a deposit on the execution of this agreement with the remaining balance to be paid on or before puppy/dog leave's Sellers premises. In the case of a puppy, the balance must be paid in full by the time the puppy reaches 8 weeks of age. If the balance is not paid within said time frame, this Agreement shall be canceled and the Buyer forfeits the deposit and any payments given hereunder.
e) If the puppy/dog is sold as Pet Quality, the Buyer agrees to have the puppy/dog spayed/neutered by a licensed veterinarian by 10 months of age. Buyer must provide proof of spay/neuter to the Seller in the form of a receipt or bill from the veterinarian and/or a spay/neuter certificate from the veterinarian. Receipt/bill/certificate must include the puppy/dogs name, breed, sex and color. Upon receipt of required documentation, the Seller will then forward to the Buyer the limited registration papers. NO REGISTRATION PAPERWORK WILL BE GIVEN UNTIL PROOF OF SPAY/NEUTER HAS BEEN PROVIDED. f) If the puppy/dog is sold as Show/Breeding Prospect, the Buyer agrees that puppy/dog will not be bred until all genetic testing has been completed and knees evaluated and certified by OFA. Buyer also agrees the puppy/dog will never be used to produce mixed breeds of any kind for any reason. In the case of a male if Buyer offers him to public stud Buyer will ensure all females are of sufficient quality and have completed the breed appropriate genetic testing as well as completed OFA certification for knees. In the case of a female, buyer agrees to not allow her to be bred prior to the age of 2 years (24 months). It is preferred that Buyer obtains a minimum of a UKC champion title or performance title on puppy/dog prior to breeding. If it is found that puppy/dog was used to produce any type of mixed offspring Buyer will forfeit ownership of puppy/dog by signing all AKC/UKC registrations/ownership over to Breeder/Seller as well as pay an additional fee of $10,000 in damages and repossession fees to Breeder/Seller.
g) Any other arrangements may only be made with the Seller's written consent.
h) This contract applies to the original puppy/dog only and is nontransferable to a second party.
3. MAINTENANCE
a) Buyer agrees to maintain this puppy/dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites, and - where needed/recommended by veterinarian - heartworm preventative medication.
b) Buyer further agrees to provide proper exercise as needed in order to maintain this puppy/dog in proper weight and physical shape. A proper diet consists of top-quality puppy/dog food.
c) Buyer agrees Seller will REPOSSESS PUPPY/DOG/BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller and with no money/expense paid/returned/refunded to buyer.
d) The Buyer agrees to maintain preventative care of the puppy/dog such as proper nutrition, proper exercise, PROPER GROOMING and regular veterinary check-ups.
e) Buyer agrees that puppy/dog will not be tethered indoors or outdoors, will not be crated excessively, will not be allowed to roam loose, left outside unattended or let loose in an unfenced area. Puppy/dog will be walked/exercised on leash or inside a securely fenced area. 4. GENERAL
a) At no time is this puppy/dog to be placed in a shelter or rescue! Buyer agrees that if at any time during the lifetime of the puppy/dog Buyer is no longer able or willing to care for the puppy/dog they will notify Seller and return puppy/dog to the Seller, at Buyer’s expense, along with his/her AKC/UKC registration papers signed over to Jennifer Casse (seller) along with all medical records. Buyer agrees to never give puppy/dog away to family, friends, strangers, shelters, rescues, laboratories, pet stores, agents, etc. Buyer understands there will be no refund of any monies paid regarding the original purchase of the puppy/dog, any medical costs, maintenance cost (grooming, food, supplies, etc). The puppy/dog you have purchased is not to be sold unless spayed/neutered and discussed with breeder first. If it is found that the puppy/dog was sold intact an additional $2,500.00 fee will be paid to the breeder.
b) Should Buyer choose to break any of the covenants of this Contract, the Contract will be considered null and void, and Seller will have the right to repossess puppy/dog with no cost to seller and no refund of monies to buyer. If repossession is required the buyer will provide all AKC/UKC registrations signed over to Jennifer Casse (breeder) and additional $2,500.00 fee in damages will be paid to breeder.
c) The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy/dog and that the Buyer will not sell this puppy/dog or it's any of its progeny to any agent, pet store, laboratory or shelter.
d) All monies mentioned in this contract are in United States Dollars. No refunds are given under any circumstances.
5. BUYER’S UNDERSTANDING
The Buyer is completely satisfied and waives any and all claims regarding the puppy/dog's conformation and outward appearance. Buyer understands that Breeder/seller does not guarantee show worthiness, ability to obtain a champion title in any venue or breeding ability when purchasing a puppy/dog under 1 year (12 months) of age. Buyer agrees that he/she understands this contract fully, will comply with this contract, and that this contract is under the jurisdiction of the State of North Carolina, Wilkes County. It is agreed the place of venue shall be Wilkes County, North Carolina.
